General selling conditions

Preamble

The following conditions settle the selling relation between :

  • The Sarl ADI company, 7500 € issued capital and register to the Lyon trade register under the RCS 410 114 524, located on: 42, chemin de Moly, 69230 Saint Genis Laval, France, nominated below as “ADI”
  • All the person who will buy one or several products on line on the website www.dogme96.com nominated below as the “customer”

The Order

Each order means the entire acceptance of the general selling conditions hereby. No order will be accepted before the full payment will be done ADI commit to deliver the orders received within the available stock
If one item is not available, the customer will be inform at the soonest and will have the possibility to select another items at the same value
In case, after 7 days, the item selected will remain out of stock, or never reproduce, ADI can select another similar style, with the same quality or even better with a similar price The current information will be written in the English language and will be confirmed at the delivery of the ordered items. ADI could refuse to the deliver a customer order if there is a previous payment conflict

Delivery

The products will be sent to the delivery address mentioned by the customer during the order process subject to the authorise addresses mentioned in the selling offer. In case the address is not correctly written by the customer, ADI cannot be responsible if the goods ordered are not delivered. ADI commit itself to deliver the goods at the soonest In case the parcel is not taken by the customer or incorrect address, ADI will inform by email the customer upon receive the parcel back and if no reply from the customer within 2 (two) months, the item will belong to ADI again.

The prices

ADI has the rights to modify at any time the prices but the order will be invoice at the price shown during the order confirmation (subject to products selected available in stock) The products remain the property of ADI until the payment is received by ADI The prices shown on the website are in Euros including all taxes except the transportation cost to be pay by the customer. Any VAT rate change will be automatically reflected on the price at the date of the administration request. On the e-shop order, the total price shown on the order confirmation include the product price, packing cost and transportation costs In special case, the customer can be invoice for additional transportation cost but the amount will be notify on the offer.

Payment terms

The full payment is required to get the order confirmation. The customer has the following payment choice :

  • By credit card : the customer need to fulfil the requested information such as, name holder, numbers, expiry date and cryptogram (3 last numbers on the back side). The information given will allow ADI to get the payment done for the amount confirmed on the order
  • By Paypal through the customer account number

No shipment will be done against payment whatever reason ADI will stay the owner of the goods until the full payment by the customer For security purpose no other payment terms beside the two above will be accepted by ADI .

Nominatives information

The information and data concerning the customer are needed to manage his orders. According the “loi informatique et liberté from French law dated on January 6th, 1978” , the customer is allowed to modify his personal data , it is just necessary to sent an email to contact@dogme96.com or by post to ADI Sarl, 42, chemin de Moly, 69230 Saint Genis Laval, France mentioning the name, address and customer number if possible or go to ”my account “on line

Responsability

The products offer on the e-shop www.dogme96.com are in accordance with the French laws. It is the customer responsibility to check with the local authorities that they are in compliance with the local regulations before importing them. All the products are designed under the trade mark DOGME96

All the pictures and sentence to show and define the products are not contractual. ADI do not take any commitment if an error occurs on the pictures or on the explanation of the products The responsibility of ADI cannot be committed in case of “Force Majeure “due to strikes, carrier, post and communications perturbations, fire, and flood. ADI will not be entitled to pay indirect damages due to the above “Force Majeure”, nor expenses or profit loss.

Intellectual Property

All the text, comment, pictures, shown inside the website www.dogme96.com are sole intellectual property of ADI. Therefore and in accordance with the Intellectual property code, only the private use is allowed. All other use are considered as counterfeiting and punished by law.

Governing Law and Jurisdiction

The above conditions shall be governed by and construed in all respect in accordance with the French laws and the following law articles: L211-4, L211-5, and L211-12 of the CODE DE LA CONSOMMATION Article 1641 and 1648 AL1 of the CODE CIVIL The parties hereto hereby irrevocably submit to the non-exclusive jurisdiction of the French court for all purpose in connection with

Personnal data

DOGME96 is collecting personal data from the customer who open an account on the website. All the information required are needed for the management of the orders, deliveries and invoicing and those information are mandatory for the e-shopping. Except opposition by the customer when creating the account, those information could be transfer to the DOGME96 commercial partners for further commercial offers In accordance with the law n° 78-17 of January 1978, relating to computer data, files and liberties, for the current website a declaration to the “COMMISSION NATIONALE DE L’INFORMATIQUE ET DES LIBERTES (CNIL) has been registered under the number 1983343.
